Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the website (https://tiarahandicrafts.in/) or purchasing products from Tiara Handicrafts and Home Decor. By using our services, you agree to be bound by these Terms.
1. Product Disclaimer & Artisan Nature
1.1 Handcrafted Variations: Our products, specifically the Brass Gods and Copper Fine Casted Statues, are handcrafted by skilled artisans. As a result, no two pieces are identical. Small variations in carving, polish, weight, and dimensions are hallmarks of artisanal craftsmanship and are not considered defects.
1.2 Material Integrity: Brass and copper are reactive metals. Over time, they may develop a natural patina (darkening). We are not responsible for the natural aging process of the metal once the product is in the customer’s environment.
1.3 Color Accuracy: We endeavor to display product colors as accurately as possible. However, due to individual monitor settings and professional studio lighting, the actual color of the statue may vary slightly from what you see on your screen.
2. Orders and Pricing
2.1 Order Acceptance: We reserve the right to refuse or cancel any order for reasons including but not limited to: product availability, errors in the description or price, or suspicion of fraudulent activity.
2.2 Pricing: Prices are listed in [Insert Currency, e.g., INR]. While we strive for accuracy, errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.
3. Shipping and Transit Risk
3.1 Domestic and International Shipping: We ship from our hub in Pallavaram, Chennai. Shipping costs and estimated delivery dates are calculated at checkout.
3.2 Packaging: Given the weight and intricate detail of fine-casted statues, we use premium, multi-layered industrial packaging to ensure safety.
3.3 Transfer of Risk: Title and risk of loss pass to the customer upon delivery of the goods to the carrier. While we assist in tracking, we are not liable for delays caused by customs (for international orders) or local courier disruptions.
4. Cancellation, Returns, and Refunds
4.1 Cancellation: Orders can only be cancelled within 12 hours of placement, as we begin the packing and crating process immediately for heavy statues.
4.2 Damage in Transit: If a statue arrives broken or significantly damaged: ● You must record an unboxing video starting from the sealed package to the reveal of the damage. ● Report the damage to tiaratradingcompany@gmail.com within 48 hours of delivery. ● Claims without an unboxing video or reported after 48 hours will not be entertained.
4.3 No Returns for "Change of Mind": Due to the high cost of logistics and the fragile nature of heavy metal castings, we do not accept returns based on personal preference or "change of mind."
5. User Conduct and Intellectual Property
5.1 Content Ownership: All content on this website, including but not limited to images of statues, logo designs, and text descriptions, is the exclusive intellectual property of Tiara Trading Company. Any unauthorized reproduction or "hotlinking" of our product images for commercial use is strictly prohibited.
5.2 Prohibited Use: You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.
6. Limitation of Liability To the maximum extent permitted by law, Tiara Handicrafts and Home Decor shall not be liable for any direct, indirect, incidental, or punitive damages resulting from your use of the products, including but not limited to injuries caused by improper handling of heavy statues or allergic reactions to metal alloys.
7. Governing Law These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.
